Brympton Parish Council recommend REFUSAL of this application  in accordance with policy 49 of the Somerset & Exmoor National Park Joint Structure Plan, namely "provide access for pedestrians, people with disabilities, cyclists and public transport"

The approved application (04/03336/FUL) for this site included a condition that

"prior to the site first being brought into use, a 3.0m wide strip of land across the application site connecting Mead Avenue to Western Avenue shall be dedicated to Somerset County Council along with the land necessary to implement 2.5m x 20.0m visibility splays to the rear of the footway/verge, for the purposes of constructing an adoptable pedestrian/cycle route.

Reason:  In the interest of maintaining pedestrian and cycle links to accord with policy 49 of the Somerset & Exmoor National Park Joint Structure Plan"

Although the strip of land has been dedicated to the County Council, the key word is that it was for the purposes of constructing an adoptable pedestrian/cycle route.  It is patently obvious that, due to the severe change in levels, the cost of constructing a pedestrian/cycle route is such that it will be many years before the route can be completed and the pedestrian/cycle route adoptable.  Therefore, until such time as the footpath is completed in a manner suitable for purpose, the traditional use of the site, as a short cut for local public & football fans must be allowed to continue.

Recommendation:             Refusal – for the following reasons:

No transport plan – a sustainable transport policy is required.  The application advises that there are 38 spaces designated ‘operational parking’ but that there will be 59 staff.  Due to heavy congestion transporters often offload on Lufton Way because they cannot access the Ford Garage via Warrior/Challenger due to on-street parking – so although provision is shown on site for unloading the Parish Council is firmly of the belief that it will not be able to be used.  The Parish Council suggest that consideration is given to a re-arrangement of the access layout, as there are such concerns over access to the site by transporters.

 There is no public transport adjacent to the site – where will the additional staff park except, presumably, on already very congested estate roads.  A Section 106 Agreement should finance assistance with a bus service.   If staff are expected to cycle there should be a designated area for bicycle parking and facilities available for staff to shower & change for work.   

 Increased traffic generated by this proposal will exacerbate pedestrian crossing issues off site. A Section 106 agreement should provide a contribution towards a controlled pedestrian crossing.

Due to the increase in traffic that will arise in the area, the Parish Council presume that there will be a reassessment of the Asda traffic study.   

The proposed low planting will encourage parking on Lufton Way.  A landscaping scheme is required with suitable deterrents to discourage people walking through from Lufton Way.     It is important that parking along this road be stopped, the road is already extremely busy and any possibility of encouraging additional parking must be desisted.  It is important that landscaping around the Lufton Way edge of the developments should not contain raised beds, which could interfere with visibility around the sharp corner.

There are concerns over the effect on the mature trees of the south of Warrior Avenue, the Parish Council ask that it be remembered that Warrior Avenue is a memorial avenue.

 There are serious concerns over the external lighting and its effect on local residents.  Conditions over the times that lights are in operation should be imposed.

3. Please confirm that there will be no pedestrian access from Thorne Lane to the site, this is essential to ensure that cars do not use Thorne Lane for parking.

4. The Parish Council believe that traffic light control at the Copse Road/Western Avenue junction will exacerbate highway problems in the area. This should stay as existing, where vehicles driving along Western Avenue allow vehicles exiting from Copse Road to filter in.

5. Lorries leaving the business park must not be allowed to turn left and exit from Copse Road. Lorries must exit by turning right and using the Asda roundabout.

6. There is no turning area shown for the use of HGVs. Whilst the Parish Council understand that each unit will be expected to have a turning area for HGVs, it has been noted that many HGVs use existing roads as turning bays.
